1. Introduction

These Terms & Conditions (“Terms”) govern your use of the Tycoon Logistics LLC (“Tycoon,” “we,” “us,” or “our”) website at https://tycoonlogistics.online/. By accessing or using this website, you agree to these Terms.

Tycoon Logistics provides truck dispatch and carrier business support to owner-operators, small fleets, growing carriers, and new or developing carriers. Tycoon works alongside carriers as a business partner and does not act as a freight broker, the carrier, the shipper, the motor carrier, or the owner of a carrier’s trucks or freight.

These website Terms describe general rules for using our website. They do not necessarily replace a separate written service agreement that may apply to your specific relationship with Tycoon, if one exists. Where a separate written agreement applies, its terms control for that relationship.

2. Use of This Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this website by, any third party.

We reserve the right to update, modify, or remove website content at our discretion, and to restrict access where we reasonably believe these Terms have been violated.

3. Tycoon Logistics Services

Tycoon Logistics presents five primary business-support areas on this website: Dispatch, Factoring, Driver Recruitment, ELD Solutions, and Trailer Rentals.

Dispatch support may include load sourcing, rate negotiation, broker communication and vetting, load confirmations, paperwork coordination, pickup and delivery coordination, factoring coordination when needed, and ongoing dispatch support.

For Factoring, Driver Recruitment, ELD Solutions, and Trailer Rentals, Tycoon may help connect carriers with suitable third-party providers. Tycoon does not represent that it directly owns, manufactures, employs, or guarantees these third-party products or services unless explicitly stated otherwise in writing.

4. Dispatch Pricing and Payment Structure

The current dispatch pricing structure is as follows:

$350 / week

for the first $8,000 in weekly gross

+10%

on weekly gross above $8,000

Example: for $5,000 in weekly gross, the dispatch fee is $350. For $8,000 in weekly gross, the dispatch fee is $350. For $10,000 in weekly gross, the fee is $350 plus 10% of the additional $2,000, which equals $550.

Under the current dispatch offer: the broker pays the carrier directly, and Tycoon invoices the carrier separately for dispatch services. There is no long-term contract requirement. No setup fees, cancellation fees, minimum revenue requirements, or additional fees beyond this stated structure are established by these Terms.

5. No Forced Dispatch and Carrier Control

Tycoon does not use forced dispatch. The carrier makes the final decision regarding which freight opportunities to accept. Tycoon may present opportunities, provide relevant information, and assist with sourcing, communication, negotiation, and coordination, but the decision to accept any freight opportunity rests with the carrier.

The carrier retains control over its equipment, business decisions, operating preferences, and business direction.

6. Carrier Responsibilities

Carriers remain solely responsible for their own business, including but not limited to:

7. No Guarantees

Tycoon does not guarantee specific loads, rates, lanes, revenue, profits, a specific number of loads, driver placement, factoring approval, ELD availability, trailer availability, or business growth.

Freight markets, availability, rates, carrier location, equipment, customer requirements, and other factors outside Tycoon’s control can affect results. Any figures, examples, or discussions of pricing on this website are illustrative and do not constitute a guarantee of income or business outcome.

8. Third-Party Providers

For complementary business solutions such as factoring, driver recruitment, ELD solutions, trailer rentals, and other resources, Tycoon may help connect carriers with suitable third-party providers.

Third-party providers may have their own terms, pricing, contracts, eligibility requirements, privacy policies, and service conditions, which are separate from and not controlled by Tycoon. Tycoon does not guarantee the performance, availability, or outcome of any independent third-party provider or service.

9. Website Content and Intellectual Property

The Tycoon Logistics name, branding, logo, website content, original text, graphics, and website design are the property of Tycoon Logistics LLC or its licensors and are protected by applicable intellectual property laws. Tycoon does not claim ownership of third-party content that may appear on or be linked from this website.

You may not reproduce, distribute, or use Tycoon’s branding or website content without permission, except as necessary for normal, lawful use of the website.

10. External Links

This website may contain links to external websites or third-party services. Tycoon does not control every external website and is not responsible for their content, accuracy, or practices. Users should review the applicable terms and privacy policies of any third-party website they visit.

11. Website Availability and Security

Tycoon aims to keep this website available and useful, but does not guarantee uninterrupted, error-free, or completely secure website availability. We may modify, suspend, or discontinue any part of the website at any time without notice.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Tycoon Logistics LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of this website or reliance on information provided through it.

Nothing in these Terms is intended to limit liability in circumstances where such limitation is not permitted by applicable law. This provision does not constitute legal advice and should be reviewed by qualified legal counsel to confirm it is appropriate for your jurisdiction.

13. Indemnification

You agree to reasonably indemnify and hold Tycoon Logistics LLC harmless from claims, damages, or expenses arising out of your misuse of this website or your violation of these Terms, to the extent permitted by applicable law.

This provision is intended to be reasonable and mutual in spirit and should be reviewed by qualified legal counsel before being relied upon as a binding contractual term.

14. Termination and Service Relationships

The current dispatch offer does not require a long-term contract. Specific service relationships between Tycoon and a carrier may be governed by an applicable written service agreement, where one exists, and its terms would control for that relationship.

These website Terms do not, by themselves, establish specific cancellation notice periods or termination penalties.

15. Privacy

Our data practices are described separately in our Privacy Policy.

16. Changes to These Terms

Tycoon Logistics may update these Terms & Conditions from time to time. Updated Terms will be posted on this page, and the “Last Updated” date above will be revised accordingly.
